Wills and Living Trusts
A planned gift in your will or living trust, otherwise known as a bequest, is an incredible way to maximize your generosity with Hammer & NER. Your gift may be a specific dollar amount, a percentage of your estate, or the remainder after all other provisions are specified.
Wondering how you can utilize a planned gift to sustain Hammer & NER’s mission? You can use the following language as a template:
For an unrestricted gift that allows Hammer & NER to determine how to use the funds based on the most pressing needs, use the following language for your will and/or trust:
I give to Hammer Residences, Inc., a nonprofit corporation currently located in Wayzata, MN, or its successor thereto, _________ [written amount or percentage of the estate or description of property] for its unrestricted charitable use and purpose.”
To designate your provision for a particular purpose:
“I give to Hammer Residences, Inc., a nonprofit corporation currently located in Wayzata, MN, or its successor thereto, _________ [written amount or percentage of the estate or description of property]. This gift should be used for (state purpose) if and so long as Hammer Residences, Inc. determines that the need exists. If Hammer Residences, Inc. shall determine at the outset or at a later time that the need does not exist, or no longer exists or for some reason it is not possible (or prudent) to administer my gift as originally intended, then Hammer Residences, Inc. may, in its sole and uncontrolled discretion, direct the use of my bequest for a purpose related as closely as possible to that stated above.”

Appreciated securities like stock or mutual funds can be generously given to fuel Hammer & NER’s mission. Making a gift of stock or mutual funds offers a unique opportunity to maximize your generosity.
Most donors who consider this giving option prefer to make an outright gift directly to Hammer & NER. Other donors have placed a transfer on death (TOD) designation to transfer an account to Hammer & NER after their lifetime.

Real Estate
Did you know that your home, vacation property, or land can be given as a gift to Hammer & NER? If you gift a property to Hammer & NER that you have owned for longer than one year, you qualify for a federal income tax deduction for the fair market value of the home and can minimize capital gains taxes.
You may desire to give a gift of real estate to Hammer & NER in the following ways:
- An outright gift. You can deed your property directly to Hammer & NER.
- A gift in your will or living trust. You can ask your legal advisor to add a few sentences to a will or trust document to gift the property to Hammer & NER after your lifetime.
- A bargain sale. You can sell a property directly to Hammer & NER for less than the fair market value of the property. The difference between the sale price and the actual value of the property is considered a gift to Hammer & NER.
